Warranty
As a manufacturer and supplier, Verbatim Australia Pty Ltd provides a promise to consumers about what we will do if a defect occurs with our products. At Verbatim, we take pride in our product quality. This page outlines the Verbatim warranty policy to help you understand your rights and product coverage.
These promises are often referred to as voluntary warranties. Under the ACL, these are called warranties against defects. It is important to remember that a warranty against defects is provided in addition to consumer guarantees contained in the ACL, and does not limit or replace them.
Definitions
In this warranty statement:
ACL means the Australian Consumer Law Schedule to the Competition and Consumer Act 2010 (Cth).
ACL regulators include the Australian Competition and Consumer Commission (ACCC), state and territory consumer protection agencies, and, where relevant, the Australian Securities and Investments Commission (ASIC).
Additional warranty means any warranty that we provide in respect of our goods that is in addition to the consumer guarantees under the ACL, including the warranty given in section 4, under the heading “Additional Warranty”.
Goods means the products sold by Verbatim Australia Pty Ltd.
Warranty period means the period of time described in section 4, under the heading “Additional Warranty”.
Warranty statement means this warranty statement, as amended by us from time to time.
We, us or our means Verbatim Australia Pty Ltd and its related entities.
Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Additional Warranty
In addition to the ACL consumer guarantees and subject to the exclusions and limitations set out in this warranty statement, we warrant that our goods will be free from defects in materials and workmanship from the date of purchase, for the period:
Specified on the product packaging for the goods, or specified on our website from time to time.
This period of time is called the warranty period.
Subject to the provisions of the ACL, if a defect in materials or workmanship appears in our goods during the warranty period and our enquiries confirm that the goods are defective, we will (at our discretion) either repair or replace the goods, free of charge.
If any goods presented for repair under this additional warranty are capable of retaining user-generated data, repair or replacement of the goods may result in loss of the data. We accept no responsibility for any loss of data.
The benefits of this additional warranty are in addition to any rights and remedies specified in the ACL that cannot be excluded. Nothing in this additional warranty is to be interpreted as excluding, restricting or modifying any of your rights under the ACL in respect of the goods, which cannot be excluded, restricted or modified.
Eligibility
To be eligible for the additional warranty and to establish the date that the warranty period commenced:
You must provide us with a receipt or other written document as proof that the goods were purchased from an authorised distributor, reseller or retailer
You must be the original purchaser of the goods. Our additional warranty is not transferable to a subsequent purchaser if you sell the goods to another person during the warranty period.
Exclusions and Limitations
To the extent permitted by law, this additional warranty will not apply where:
The goods have been repaired, altered or modified by someone other than us or an authorised repair agent;
The alleged defect in the goods is within the parameters of acceptable industry variances.
We cannot establish any fault in the goods after testing and inspection.
The goods have been used for purposes other than the purpose for which they are designed.
The defect in the goods has arisen due to your failure to properly use and maintain the goods in accordance with our instructions or recommendations, the product specifications included in the packaging for the goods or as displayed on our website from time to time (including, but not limited to, complying with any recommended maintenance schedules); the goods have been subject to abnormal conditions or use, including environment, temperature, water, fire, humidity, pressure, stress or similar; or the defect has arisen due to abuse, misuse, neglect or accident.
To the extent permitted by law, this additional warranty does not:
extend to any damage or defects to the goods caused by normal wear and tear;
cover incompatibility or poor performance issues which arise because of specific software or hardware used/installed on your computer or device; or
entitle you to receive any form of general, consequential, punitive, incidental or special damages as a result of the defect in materials or workmanship. This includes any loss of recorded data, interruption of use, the cost of recovery of lost data, lost profits and the cost of the installation or removal of any goods, the installation of replacement goods, and any inspection, testing or redesign caused by any defect or by the repair or replacement of goods arising from a defect in the goods.
How to Make a Warranty Claim
To make a claim under this warranty statement, you must:
Contact us using the contact details below to receive a Returned Merchandise Authorisation Number (RMA Number); and
please return the goods to us in accordance with our instructions, together with your RMA Number and proof of purchase documents (such as a receipt) and full details of the alleged defect.
We will not accept goods for return or repair if an RMA number has not been issued.
Costs
If, after inspecting and testing the goods, we cannot find or replicate a defect, we may require you to pay reasonable costs for the inspection and testing.
You must also pay the reasonable costs associated with transporting the goods to us, or from the retailer to us, for the purposes of making a warranty claim (including, but not limited to, the costs of insuring the goods).
We will bear the cost of transporting the goods back to you once the warranty claim has been finalised.
No Other Warranties
Verbatim Pty Ltd makes no express warranties or representations other than those set out in this Warranty statement.
To the extent permitted by law, the replacement of the goods or part of the goods is the absolute limit of Verbatim’s liability under this Warranty statement.

Notice to Customers Relating to Repair of Goods
When you return goods to us for repair, we may (at our discretion) replace them with refurbished goods or with other goods of the exact specification, rather than undertaking the repair work. We may use refurbished parts in any repair work we complete on goods returned to us for repair.
If any goods presented for repair are capable of retaining user-generated data, repair or replacement of the goods may result in loss of this data. “User-generated data” includes, but is not limited to:
files stored on a computer hard drive; telephone numbers stored on a mobile telephone; songs stored on a portable media player; games saved on a computer console; and files stored on a USB memory device.
