Quantum Corporation ("Quantum") warrants, subject to the limitations set forth below, that this Quantum media cartridge product (the "Product") is free from defects in material and manufacture at the time of purchase. If any defect in material or manufacture appears within the warranty period, Quantum's entire liability, and your exclusive remedy is, at Quantum's sole option, for Quantum to: (a) repair the Product, (b) replace the Product or (c) refund to you the purchase price of the Product, provided that the Product is returned to Quantum with proof of purchase such as a purchase order, invoice, or sales receipt. This warranty does not apply to the failure of the Product resulting from misuse, abuse, accident, neglect or mishandling, improperly adjusted or maintained tape drives, incorrect environments, or wear from ordinary use. THIS WARRANTY IS MADE IN LIEU OF ALL OTHER RIGHTS, CONDITIONS AND WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. QUANTUM SHALL NOT BE LIABLE UNDER ANY LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT OR CONTRACT) FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST SAVINGS OR LOST DATA, IN ANY WAY RELATED TO THE PRODUCT. This warranty gives you specific legal rights and you may have other rights that vary from state to state. NOTE: All customer media cartridges returned to Quantum are sanitized using processes that are compliant with NIST Special Publication 800-88, Guidelines for Media Sanitization to maintain confidentiality of customer recorded data.
